Description
Product Liability Law in the Age of AI 3rd Edition Mark Geistfeld ISBN 9798894100883
Product Liability Law in the Age of AI is an ideal casebook for advanced torts courses that examine the evolution of products liability doctrine and its growing complexity, with sustained attention to liability issues arising from artificial intelligence and related technologies.
Now in its Third Edition, Product Liability Law in the Age of AI—authored by Mark Geistfeld, a leading authority on the intersection of tort law and emerging AI technologies—represents the next generation of products liability casebooks. Although the title has changed, this edition continues the analytical framework developed in the prior editions, with substantial revisions throughout, particularly in its treatment of software and automated systems. The text is clearly written and features an expanded set of end-of-chapter problems. Each of the book’s 51 problems provides essential background on the relevant AI technology while demonstrating how products liability doctrines and underlying principles apply to contemporary and emerging legal challenges.
Earlier casebooks often centered on the perceived tension between strict liability and negligence, as reflected in the consumer expectations test of the Restatement (Second) of Torts and the risk-utility test of the Restatement (Third) of Torts. Most courts, however, have integrated risk-utility analysis into the consumer expectations framework, producing what the author describes as “strict products liability 2.0.” This modern regime involves nuanced applications of risk-utility principles designed to fairly protect consumer expectations of product safety. Beyond teaching students how to apply the risk-utility test across a wide array of contexts, the casebook emphasizes the importance of doctrinal history, the psychology of risk assessment, and the role of products liability within the modern regulatory state.
The book illustrates how courts apply established doctrines to novel contexts, including the use of scientific evidence in toxic tort litigation, the distribution of defective products through the Amazon marketplace, and the classification of social media platforms as products or services for tort law purposes. Most chapters conclude with problem sets focused on liability issues likely to arise from emerging AI technologies. Across these problems, students develop a foundational understanding of automated systems while learning how tort law principles can address legal questions that will shape the future of products liability.
