Description
State Constitutional Law: The Modern Experience 5th Edition Jeffrey S. Sutton ISBN 9798317700904
State Constitutional Law: The Modern Experience, Fifth Edition by Jeffrey Sutton and Stephen McAllister offers an in-depth exploration of the dynamic and increasingly important world of state constitutions. This edition introduces a new section on Positive Rights, highlighting the unique feature of state constitutions that sometimes impose affirmative obligations on legislatures. It also adds four new chapters: Environmental Protection, Legislative Power, Executive Power, and Judicial Power.
The casebook situates state constitutions within the broader federal system, emphasizing the interplay between state and federal law. By comparing and contrasting federal provisions with their state counterparts—and examining state-specific provisions with no federal analogue—the text illuminates how state constitutions provide independent rights, offer innovative solutions, and influence national constitutional developments. Central themes include the expansion and interpretation of liberty and property rights, the design of political representation, and the division of power between local, state, and national governments.
The Fifth Edition incorporates contemporary issues, including state court responses to gerrymandering after Rucho v. Common Cause (2019) and abortion rights debates following Dobbs v. Jackson Women’s Health Organization (2022). It also explores structural aspects of state government, such as judicial selection, executive powers, administrative law, taxation, public finance, and local government authority.

Rental Terms

- Late Fees
- Books returned after the semester deadline accrue a weekly late fee of about 10% of the book's Brand New price, for each copy that is overdue. The rent you have already paid counts toward the book's replacement value (its Brand New price), so late fees stop once your rent plus late fees reach it. That replacement value is the most a rental can ever cost you. We email a reminder 48 hours before any charge, and any late fees are charged to the payment method you save at checkout.
- Damage Fees
- Books returned damaged beyond normal classroom wear may be assessed a damage fee, capped at the book's replacement value (its Brand New price). Any damage fees are charged to the payment method you save at checkout after we inspect the returned book.
- Return Shipping
- Returning your book is free: print a prepaid label (USPS or UPS, whichever is cheaper for your package) from your account's My Rentals page, whether you send it back early or on the semester deadline. Cancelling a shipped rental for a refund is different: there, the return label cost comes out of your refund.
- 30-Day Cancellation
- Changed your mind? Cancel an active rental within 30 days of your order from My Account → My Rentals. Cancel before your book ships and it’s free; once it has shipped, we refund the rental price minus a 15% restocking fee and the return label cost, released once we receive your book. Shipping is non-refundable.
