Description
The Law and Ethics of Lawyering 7th Edition ISBN 9781685612092
The Seventh Edition of this casebook offers a comprehensive exploration of the wide array of legal and ethical challenges lawyers face in modern practice. As in prior editions, it integrates the ABA’s Model Rules of Professional Conduct, the ALI’s Restatement of the Law Governing Lawyers, relevant case law, statutory provisions, and regulatory frameworks governing the legal profession.
This new edition includes substantial updates and presents eight new principal cases addressing timely and complex issues such as obstruction of justice, the crime-fraud exception to confidentiality, the challenges of multijurisdictional (or “migratory”) practice, and conflicts involving government lawyers. The text is now approximately 100 pages shorter, offering a more streamlined yet thorough presentation of material.
New principal cases include:
- Hinton – Ineffective assistance of counsel
- Lonich – Obstruction of justice
- Doe v. SEC – Crime-fraud exception to the duty of confidentiality
- Maxell v. Apple – Migratory lawyer issues
- In re National Prescription Opiate Litigation – Government lawyer conflicts
- McDowell – Client perjury in criminal proceedings
- Wiener, Weiss & Madison v. Fox – Lawyer-client business transactions
- McCoy v. Louisiana – Representing impaired clients
Additional updates and new commentary include:
- Lawyer immunity under Texas law
- Attorney-client privilege disputes involving Covington & Burling and the SEC
- Privilege protections for law firms
- Remedies for conflicts of interest, including analysis of the Sheppard Mullin case
- Disqualification of Fani Willis in the Georgia 2020 election investigation
- Corporate “Miranda” warnings and the Penn State scandal
- Emerging challenges in multi-district litigation
- Rule 11 issues arising from the 2020 election
- Third-party litigation funding
- Regulatory innovations, including Washington’s LLLT program and Utah’s legal “sandbox”
- The In re Stevens case and the question of whether criminal conviction is per se disqualifying for bar admission
- Arizona’s Alternative Business Structure (ABS) experiment
- The ongoing debate over ABA Model Rule 8.4(g) on discriminatory conduct by lawyers
- This edition continues to provide students with a rich, real-world understanding of professional responsibility, combining foundational doctrine with contemporary issues shaping the practice of law today.

Shipping & Returns
-
Fast, standard shipping
Most students receive their books in 3 to 9 business days.
-
Free rental returns, whenever you are done
Print a prepaid return label from your account whenever you have finished with the book, and drop it at the carrier listed on the label. Returning early costs you nothing: it is the same free label, and sending it back sooner is welcome. Just be sure it reaches us by the semester deadline to avoid late fees.
-
Purchase returns: 15% restocking fee
Purchases can be returned within 30 days in the condition you received. We will email a prepaid return label; once we receive your book, we refund the purchase price minus the 15% restocking fee and the return label cost. Original shipping is non-refundable.
-
Shipping costs calculated at checkout
Real-time rates are quoted at checkout based on your address and the books in your cart. Returning your book is always free.
Rental Terms
Return by December 28, 2026 for Fall 2026 rentals.
- Late Fees
- Books returned after the semester deadline accrue a weekly late fee of about 10% of the book's Brand New price, for each copy that is overdue. The rent you have already paid counts toward the book's replacement value (its Brand New price), so late fees stop once your rent plus late fees reach it. That replacement value is the most a rental can ever cost you. We email a reminder 48 hours before any charge, and any late fees are charged to the payment method you save at checkout.
- Damage Fees
- Books returned damaged beyond normal classroom wear may be assessed a damage fee, capped at the book's replacement value (its Brand New price). Any damage fees are charged to the payment method you save at checkout after we inspect the returned book.
- Return Shipping
- Returning your book is free: print a prepaid label (USPS or UPS, whichever is cheaper for your package) from your account's My Rentals page, whether you send it back early or on the semester deadline. Cancelling a shipped rental for a refund is different: there, the return label cost comes out of your refund.
- 30-Day Cancellation
- Changed your mind? Cancel an active rental within 30 days of your order from My Account → My Rentals. Cancel before your book ships and it’s free; once it has shipped, we refund the rental price minus a 15% restocking fee and the return label cost, released once we receive your book. Shipping is non-refundable.
