Description
Dispute Resolution: Beyond the Adversarial Mode 4th Edition by Carrie Menkel-Meadow ISBN 9781543847130
The new edition of Dispute Resolution: Beyond the Adversarial Model presents a thorough and engaging exploration of negotiation, mediation, and arbitration, followed by in-depth chapters on hybrid and multiparty processes, dispute system design, and counseling clients about dispute resolution options.
This casebook offers a comprehensive portrait of contemporary ADR, organized around four core elements for each primary process—Negotiation, Mediation, Arbitration, and hybrid approaches:
- Theoretical foundations defining the process,
- Practical skills essential for effective practice,
- Ethical considerations and guidance for advising clients,
- Legal and policy analysis shaping each area of dispute resolution.
Throughout, students are invited to become active participants in resolving problems across a range of contexts—including variations in gender, race, culture, and current events. The award-winning authors enhance the learning experience with thought-provoking readings, exercises, and discussion problems, creating a dynamic, instructor- and student-friendly text.
New to the Fourth Edition
- Expanded coverage of Online Dispute Resolution (ODR) and the evolving field of Dispute System Design (DSD)
- The latest U.S. Supreme Court decisions on arbitration and new empirical research on mediation and negotiation
- Application-focused “Problem Boxes” connecting theory to contemporary real-world issues for class discussion
- Analysis of ADR’s role in a post-COVID landscape, both domestically and internationally
Benefits for Professors and Students
- A shorter, more streamlined volume than many other ADR casebooks
- Exercises and discussion problems woven throughout the text
- A flexible structure allowing instructors to cover one chapter per week in a typical ADR course
- Comprehensive, stand-alone chapters on international and multi-party dispute resolution
- Authorship from internationally recognized scholars and practitioners, known for contributions across ADR scholarship, practice, policy, and standards development
- Readings that balance theory with theory-in-use, including cases, behaviorally grounded scholarship, empirical studies, and relevant statutory and regulatory materials
- A rich selection of challenging and contemporary readings, featuring perspectives from Fisher, Ury, and Patton’s Getting to Yes; Raiffa’s The Art and Science of Negotiation; modern deliberative democracy; group facilitation and decision-making; and client counseling in ADR
- Key cases such as Viking River Cruises v. Moriana, AT&T v. Concepción, other recent Supreme Court decisions on arbitration, and materials addressing the enforcement of negotiation and mediation agreements

Shipping & Returns
-
Fast, standard shipping
Most students receive their books in 3 to 9 business days.
-
Free rental returns, whenever you are done
Print a prepaid return label from your account whenever you have finished with the book, and drop it at the carrier listed on the label. Returning early costs you nothing: it is the same free label, and sending it back sooner is welcome. Just be sure it reaches us by the semester deadline to avoid late fees.
-
Purchase returns: 15% restocking fee
Purchases can be returned within 30 days in the condition you received. We will email a prepaid return label; once we receive your book, we refund the purchase price minus the 15% restocking fee and the return label cost. Original shipping is non-refundable.
-
Shipping costs calculated at checkout
Real-time rates are quoted at checkout based on your address and the books in your cart. Returning your book is always free.
Rental Terms
Return by December 28, 2026 for Fall 2026 rentals.
- Late Fees
- Books returned after the semester deadline accrue a weekly late fee of about 10% of the book's Brand New price, for each copy that is overdue. The rent you have already paid counts toward the book's replacement value (its Brand New price), so late fees stop once your rent plus late fees reach it. That replacement value is the most a rental can ever cost you. We email a reminder 48 hours before any charge, and any late fees are charged to the payment method you save at checkout.
- Damage Fees
- Books returned damaged beyond normal classroom wear may be assessed a damage fee, capped at the book's replacement value (its Brand New price). Any damage fees are charged to the payment method you save at checkout after we inspect the returned book.
- Return Shipping
- Returning your book is free: print a prepaid label (USPS or UPS, whichever is cheaper for your package) from your account's My Rentals page, whether you send it back early or on the semester deadline. Cancelling a shipped rental for a refund is different: there, the return label cost comes out of your refund.
- 30-Day Cancellation
- Changed your mind? Cancel an active rental within 30 days of your order from My Account → My Rentals. Cancel before your book ships and it’s free; once it has shipped, we refund the rental price minus a 15% restocking fee and the return label cost, released once we receive your book. Shipping is non-refundable.
