Civil Procedure Second Edition: A Practical and Engaging Approach to Learning Procedural Law
The Second Edition of Civil Procedure is designed to equip students with the foundational knowledge and analytical skills necessary for success in the classroom and beyond. With its clear explanations, structured frameworks, and engaging case selection, this casebook ensures that students arrive at each class session prepared not only to grasp the doctrine and mechanics of civil procedure but also to understand its real-world significance in litigation.
Unlike traditional casebooks that rely primarily on appellate decisions to explore abstract legal questions, this book takes a practice-oriented approach. The authors have carefully selected cases that illuminate the core functions and challenges of civil procedure, including decisions by district and magistrate judges, which offer insight into how procedural rules operate in actual litigation. Thoughtfully crafted notes and questions accompany each case, guiding students step by step through the implications of procedural rules in both policy and litigation strategy.
What’s New in the Second Edition?
- Updated Chapter on Personal Jurisdiction – Incorporates the Supreme Court’s latest rulings in Ford Motor Co. v. Montana (2021) and Mallory v. Norfolk Southern Railway Co. (2023), ensuring students engage with the most current legal standards.
- Expanded Coverage – Includes new cases on issue preclusion, supplemental jurisdiction, personal jurisdiction, service of process, and venue, deepening students’ understanding of these crucial topics.
- Comprehensive Refinements – Updates throughout the book enhance clarity and ensure coverage of the latest legal developments.
Why This Book Stands Out for Professors and Students
- Clear and Accessible Explanations – Each topic is carefully introduced to prime students for case reading and class discussion, ensuring they grasp key concepts before diving into complex procedural rules.
- Step-by-Step Learning – Thoughtfully designed Notes and Questions guide students through case holdings, procedural histories, and key takeaways, helping them uncover nuances that might otherwise be overlooked.
- Terminology Tips – Demystifies the often-confusing language of civil procedure, giving students confidence in their ability to engage with the subject.
- Strategic Insights – “Strategy Sessions” explore how procedural rules influence litigation strategy, settlement negotiations, and case outcomes, connecting doctrine to practice.
- Big-Picture Thinking – “The Big Picture” boxes help students contextualize each topic, identifying broader trends and implications across procedural doctrines.
By balancing doctrinal clarity with practical application, this casebook ensures that first-year law students develop the critical thinking skills necessary to navigate civil procedure with confidence. The Second Edition continues to be a highly teachable, engaging, and student-friendly resource that prepares future litigators for success.

Rental Terms
Return by December 28, 2026 for Fall 2026 rentals.
- Late Fees
- Books returned after the semester deadline accrue a weekly late fee of about 10% of the book's Brand New price, for each copy that is overdue. The rent you have already paid counts toward the book's replacement value (its Brand New price), so late fees stop once your rent plus late fees reach it. That replacement value is the most a rental can ever cost you. We email a reminder 48 hours before any charge, and any late fees are charged to the payment method you save at checkout.
- Damage Fees
- Books returned damaged beyond normal classroom wear may be assessed a damage fee, capped at the book's replacement value (its Brand New price). Any damage fees are charged to the payment method you save at checkout after we inspect the returned book.
- Return Shipping
- Returning your book is free with no deduction if it reaches us by your semester return date, or after it's already overdue. Print a prepaid label (USPS or UPS, whichever is cheaper for your package) from your account's My Rentals page. Returning it EARLY, before your semester return date, deducts a 15% restocking fee and the label cost from your refund, the same as cancelling a shipped rental for a refund.
- 30-Day Cancellation
- Changed your mind? Cancel an active rental within 30 days of your order from My Account → My Rentals. Cancel before your book ships and it’s free; once it has shipped, we refund the rental price minus a 15% restocking fee and the return label cost, released once we receive your book. Shipping is non-refundable.
