This book is the first in a two-part series that is designed to teach you how lawsuits are handled in the Texas courts, from the earliest client contact through a final appeal to the Texas Supreme Court. This book covers the pre-trial phases of litigation, from pre-filing activities through forum selection (jurisdiction and venue), pleadings, joinder of claims and parties, issue and claims preclusion, discovery scope and practice, summary judgment practice and other methods of dispute resolution.
This edition gives emphasis to the changes in pleading practice before and after the adoption of the Rules of Practice Act of 1940, the impact of Tort Reform Legislation on the joinder of claims and parties and other procedural issues, class action litigation, and the continuing development and operation of pretrial discovery and pretrial practice adopted during the end of the 20th century and the beginning decades of the 21st century.
The book uses notes to provide supplementary information as well as discussion questions designed to probe your understanding of the material and the policy issues. Most sections of the book also contain practice exercises so that you can test your ability to apply the rules. Finally, a number of chapters are followed by an appendix containing former Texas bar examination questions, which should be helpful in learning about and preparing for practice.

Rental Terms

- Late Fees
- Books returned after the semester deadline accrue a weekly late fee of about 10% of the book's Brand New price. Late fees stop once your book ships back or the total reaches the book's replacement value (its Brand New price) - you never pay more than that. We email a reminder 48 hours before any charge, and any late fees are charged to the payment method you save at checkout.
- Damage Fees
- Books returned damaged beyond normal classroom wear may be assessed a damage fee, capped at the book's replacement value (its Brand New price). Any damage fees are charged to the payment method you save at checkout after we inspect the returned book.
- Return Shipping
- Returning your book is free: print a prepaid label (USPS or UPS, whichever is cheaper for your package) from your account's My Rentals page, whether you send it back early or on the semester deadline. Cancelling a shipped rental for a refund is different: there, the return label cost comes out of your refund.
- 30-Day Cancellation
- Changed your mind? Cancel an active rental within 30 days of your order from My Account → My Rentals. Cancel before your book ships and it’s free; once it has shipped, we refund the rental price minus a 15% restocking fee and the return label cost, released once we receive your book. Shipping is non-refundable.
