Description
Legislation and Regulation: A Contemporary Approach 3rd Edition Peter J. Smith
ISBN 9798317706302
This interactive casebook is designed to make the study of Legislation and Regulation both accessible to students and effective for instructors. Combining carefully selected primary materials with innovative teaching features, the text provides a clear and engaging introduction to the processes through which statutes are enacted, interpreted, and implemented by administrative agencies.
Students receive access to a digital version of the book featuring live hyperlinks to source materials and integrated assessment questions at the end of each chapter, encouraging active learning and self-evaluation throughout the course. The casebook's interactive design helps students engage directly with complex legal concepts while developing the analytical skills necessary for statutory interpretation and administrative law.
The book features thoughtfully selected cases accompanied by substantial excerpts that allow students to examine judicial reasoning in context rather than through heavily edited summaries. Extensive editorial materials guide students through the opinions, highlighting key arguments, interpretive methodologies, and doctrinal developments. Strategic text boxes draw attention to important concepts and recurring themes, helping students identify the principles that shape legislative and regulatory decision-making.
Throughout the text, introductory explanations, discussion questions, hypothetical problems, and competing viewpoints encourage students to critically evaluate the legal, institutional, and policy issues raised by modern governance. By presenting multiple perspectives on contested questions, the casebook fosters deeper understanding of the challenges courts, legislatures, and administrative agencies face when creating, interpreting, and enforcing law.
The casebook provides comprehensive coverage of both statutory interpretation and administrative law, examining the relationship between legislatures, courts, and regulatory agencies in the modern administrative state. Students are introduced to the principal theories and tools of statutory interpretation, as well as the doctrines governing agency authority, rulemaking, adjudication, judicial review, and regulatory accountability.
The Third Edition has been updated to reflect significant recent developments in legislation and administrative law, including new cases addressing the major questions doctrine, additional explanatory text boxes, and expanded note materials that provide greater context for emerging debates in statutory interpretation and agency governance.
Combining rigorous legal analysis with innovative pedagogical features, this casebook helps students understand not only the rules governing legislation and regulation, but also the institutional structures and policy choices that shape the development of modern law.

Rental Terms
Return by December 28, 2026 for Fall 2026 rentals.
- Late Fees
- Books returned after the semester deadline accrue a weekly late fee of about 10% of the book's Brand New price, for each copy that is overdue. The rent you have already paid counts toward the book's replacement value (its Brand New price), so late fees stop once your rent plus late fees reach it. - Damage Fees
- Books returned damaged beyond normal classroom wear may be assessed a damage fee, capped at the book's replacement value (its Brand New price). Any damage fees are charged to the payment method you save at checkout after we inspect the returned book.
- Return Shipping
- Returning your book is free with no deduction if it reaches us by your semester return date, or after it's already overdue. Print a prepaid label (USPS or UPS, whichever is cheaper for your package) from your account's My Rentals page. Returning it EARLY, before your semester return date, deducts a 15% restocking fee and the label cost from your refund, the same as cancelling a shipped rental for a refund.
- 30-Day Cancellation
- Changed your mind? Cancel an active rental within 30 days of your order from My Account → My Rentals. Cancel before your book ships and it’s free; once it has shipped, we refund the rental price minus a 15% restocking fee and the return label cost, released once we receive your book. Shipping is non-refundable.
