This casebook provides a comprehensive exploration of federal administrative law, emphasizing its current doctrine and historical development across four key areas:
- Separation of Powers: Examining the constitutional framework governing agency authority.
- Procedural Requirements: Covering statutory and constitutional mandates for agency rulemaking and adjudication.
- Scope of Judicial Review: Analyzing the boundaries of courts' oversight of agency actions.
- Judicial Review Accessibility: Addressing the availability and timing of judicial intervention.
The text focuses primarily on federal administrative law, offering a solid foundation that can be applied to state or other settings if needed. Its hallmark features include a clear organization and a direct, transparent approach that ensures clarity and accessibility for students.
New in the Tenth Edition:
- Updated Case Law: Includes three new principal cases, notably the 2024 Loper Bright/Relentless decision that overruled the Chevron doctrine, reshaping the judicial review of agency interpretations.
- Revised Materials on Judicial Review: Presents a condensed historical narrative of the Chevron doctrine, offering context for understanding its evolution and current implications.
- Expanded Notes and Case Updates: Incorporates the latest developments in areas like subdelegation of legislative power and the interpretation of "property" under the Due Process Clauses.
- Enhanced Focus on Statutory Interpretation: Reflects the growing inclusion of administrative law in first-year law curricula, serving as a key resource for teaching statutory interpretation basics.
With its robust content and thoughtful updates, this edition ensures students are equipped to navigate the complexities of administrative law in today’s rapidly changing legal environment.
