Description
Administrative Law and Regulatory Policy Problems Text and Cases 9th Edition Stephen G. Breyer ISBN 9781543825824
The Ninth Edition of Administrative Law and Regulatory Policy: Problems, Text, and Cases delivers a streamlined, modern update to a casebook long recognized for its intellectual rigor, breadth of coverage, and commitment to placing administrative procedure within real-world regulatory debates. While preserving the comprehensive and contextual approach that has made the book a mainstay in the field, the latest edition reflects careful revision to enhance clarity, accessibility, and pedagogical value.
This edition continues to feature outstanding authorship and a diverse range of carefully selected materials, including leading cases, commentary, and thought-provoking problems. It explores how administrative law shapes—and is shaped by—key policy areas, offering students a grounded understanding of both procedural mechanics and substantive stakes. Extensive notes and questions help explain complex doctrines while encouraging critical reflection and classroom dialogue.
What’s New in the Ninth Edition:
- A complete update of case law, notes, and questions to reflect the latest legal developments.
- A more streamlined and accessible design—despite expanded coverage, the book is shorter than the Eighth Edition.
- Coverage of recent landmark Supreme Court decisions, including:
- Gundy v. United States (nondelegation)
- Lucia v. SEC (appointments clause and officers of the U.S.)
- Seila Law LLC v. CFPB (presidential removal authority)
- Oil States Energy Services v. Greene’s Energy Group (constitutionality of agency adjudication)
- Kisor v. Wilkie (Auer deference reconsidered)
- DHS v. Regents of the University of California (DACA rescission and arbitrary and capricious review)
- Department of Commerce v. New York (pretext in agency decision-making)
- Little Sisters of the Poor v. Pennsylvania (interim final rulemaking)
Highlights and Benefits:
- Comprehensive treatment of the core processes of rulemaking and adjudication.
- In-depth analysis of evolving doctrines, including Chevron and Auer deference and the nondelegation principle.
- Balanced attention to both doctrinal development and the normative justifications (and criticisms) of regulatory practice.
- Problem sets that test student comprehension and foster applied learning.
- A new companion website offering:
- Supplementary assignments and materials, including an introductory case study and enforcement exercises.
- Access to real-world agency documents, such as rulemaking notices, FOIA materials, and complaints.
- Curated links to relevant online resources and agency sites.
- Visual content and updates on emerging statutes, decisions, and administrative developments.
This edition equips students to understand administrative law not only as a body of legal doctrine, but as a powerful tool that governs how modern government functions—and how it is challenged, interpreted, and reimagined.

-
Free rental returns, whenever you are done
Print a prepaid return label from your account whenever you have finished with the book, and drop it at the carrier listed on the label. Returning early costs you nothing: it is the same free label, and sending it back sooner is welcome. Just be sure it reaches us by the semester deadline to avoid late fees.
-
Purchase returns: 15% restocking fee
Purchases can be returned within 30 days in the condition you received. We will email a prepaid return label; once we receive your book, we refund the purchase price minus the 15% restocking fee and the return label cost. Original shipping is non-refundable.

Shipping costs calculated at checkout
Real-time rates are quoted at checkout based on your address and the books in your cart. Returning your book is always free.
Rental Terms
Return by December 28, 2026 for Fall 2026 rentals.
- Late Fees
- Books returned after the semester deadline accrue a weekly late fee of about 10% of the book's Brand New price, for each copy that is overdue. The rent you have already paid counts toward the book's replacement value (its Brand New price), so late fees stop once your rent plus late fees reach it. That replacement value is the most a rental can ever cost you. We email a reminder 48 hours before any charge, and any late fees are charged to the payment method you save at checkout.
- Damage Fees
- Books returned damaged beyond normal classroom wear may be assessed a damage fee, capped at the book's replacement value (its Brand New price). Any damage fees are charged to the payment method you save at checkout after we inspect the returned book.
- Return Shipping
- Returning your book is free: print a prepaid label (USPS or UPS, whichever is cheaper for your package) from your account's My Rentals page, whether you send it back early or on the semester deadline. Cancelling a shipped rental for a refund is different: there, the return label cost comes out of your refund.
- 30-Day Cancellation
- Changed your mind? Cancel an active rental within 30 days of your order from My Account → My Rentals. Cancel before your book ships and it’s free; once it has shipped, we refund the rental price minus a 15% restocking fee and the return label cost, released once we receive your book. Shipping is non-refundable.
