Description
Law of Employee Pension and Welfare Benefits 3rd Edition Lawrence Frolik ISBN 9780769852805
This book provides a comprehensive introduction to how ERISA and the Internal Revenue Code (IRC) regulate and protect employee pension and welfare benefit plans. It is designed with several guiding principles in mind:
Coverage. The book balances comprehensiveness with teachability. Cases and secondary materials are carefully selected, and concise commentary helps students see both the “forest” and the “trees.” Case law is emphasized for litigated issues such as preemption, while statutory and regulatory materials are highlighted for less-litigated topics, including qualified plan nondiscrimination requirements. The text also draws on scholarly articles to illuminate the policy implications of employee benefits law.
Case Selection. The authors focus on cases that illustrate judicial interpretation and application of ERISA, with a preference for Supreme Court decisions. Only cases that meaningfully aid understanding are included, and the text avoids brief or marginal “squib” cases in favor of deeper commentary.
Questions and Problems. To engage students actively, the book includes numerous questions and problems that require careful analysis of the relevant case law or statutes.
Adaptability. Recognizing that employee benefits courses vary based on instructor interests and student needs, the book is designed to be flexible, accommodating a range of teaching approaches.
Teacher’s Manual. The comprehensive Teacher’s Manual provides case summaries, answers to all questions and problems, additional commentary, citations to helpful articles, and guidance on how the authors approach the material.
Updates. Reflecting the evolving nature of employee benefits law, the book is supplemented annually with updates on case law and relevant statutory and regulatory changes.
The Third Edition introduces significant new content, including:
-
Expanded discussion of 401(k) plans, including their popularity, potential, and associated challenges;
-
Coverage of the Patient Protection and Affordable Care Act and its interaction with ERISA welfare plans;
-
Complete and detailed analysis of recent Supreme Court ERISA decisions, including Cigna Corporation v. Amara and Conkright v. Frommert;
-
Expanded coverage of fiduciary duty cases related to 401(k) plans, including Hecker v. Deere & Company, Jeremy Braden v. Wal-Mart Stores, Inc., and Difelice v. U.S. Airways;
-
Updated and expanded explanations of ERISA preemption of state law.
This edition equips students and practitioners alike with a clear, practical, and up-to-date understanding of employee benefits law.

Returning it early, before that date, deducts a 15% restocking fee and the label cost from your refund.

Shipping costs calculated at checkout
Real-time rates are quoted at checkout based on your address and the books in your cart. Returning your book by your semester date is always free; an early return deducts the restocking fee and label cost from your refund instead.
Rental Terms
Return by December 28, 2026 for Fall 2026 rentals.
- Late Fees
- Books returned after the semester deadline accrue a weekly late fee of about 10% of the book's Brand New price, for each copy that is overdue. The rent you have already paid counts toward the book's replacement value (its Brand New price), so late fees stop once your rent plus late fees reach it. That replacement value is the most a rental can ever cost you. We email a reminder 48 hours before any charge, and any late fees are charged to the payment method you save at checkout.
- Damage Fees
- Books returned damaged beyond normal classroom wear may be assessed a damage fee, capped at the book's replacement value (its Brand New price). Any damage fees are charged to the payment method you save at checkout after we inspect the returned book.
- Return Shipping
- Returning your book is free with no deduction if it reaches us by your semester return date, or after it's already overdue. Print a prepaid label (USPS or UPS, whichever is cheaper for your package) from your account's My Rentals page. Returning it EARLY, before your semester return date, deducts a 15% restocking fee and the label cost from your refund, the same as cancelling a shipped rental for a refund.
- 30-Day Cancellation
- Changed your mind? Cancel an active rental within 30 days of your order from My Account → My Rentals. Cancel before your book ships and it’s free; once it has shipped, we refund the rental price minus a 15% restocking fee and the return label cost, released once we receive your book. Shipping is non-refundable.
