Civil Rights Enforcement, Third Edition
Described as “superb” and “inspiring” in a foreword by Dean Erwin Chemerinsky, Civil Rights Enforcement, Third Edition, examines the doctrines governing the enforcement of civil rights through private civil actions, with particular attention to issues most relevant to litigators. Organized from a litigator’s perspective, the book uses detailed hypothetical problems to help students apply legal principles to realistic cases. Notes and questions also explore strategic considerations in impact litigation and broader debates about constitutional enforcement, federalism, judicial review, and the relationship between rights and remedies.
New to the 3rd Edition
- New sections on presidential immunity, injunctions against municipal constitutional violations, and universal injunctions.
- New principal cases addressing:
- Universal injunctions: Trump v. CASA, Inc.
- Presidential immunity: Blassingame v. Trump
- Attorneys’ fees: Lackey v. Stinnie
- Enforcement of statutory rights under § 1983: Health & Hospital Corp. of Marion County v. Talevski and Medina v. Planned Parenthood of South Atlantic.
- Expanded coverage of recent Supreme Court decisions and developing trends involving standing, mootness, the Heck bar, sovereign immunity, excessive force, federal officer liability and Bivens, equitable enforcement of statutory rights, and qualified immunity.
- More than a dozen new hypothetical problems, along with revised exercises.
- Expanded application sections and explanatory material addressing emerging issues, including suits in equity and the Federal Tort Claims Act.
Key Features and Benefits
- Detailed hypothetical problems: Multi-layered fact patterns incorporate hypothetical statutes, precedents, and litigation documents, many based on actual cases.
- Practical application: Notes examine how enforcement doctrines operate, the incentives they create, important appellate decisions, and current controversies.
- Historical context: A prologue and follow-up discussions explore the civil rights movement and the development of impact litigation.
- Theoretical perspectives: Commentary and questions examine the role of federal courts and the relationship between legal rights and available remedies.
- Comprehensive statutory coverage: Detailed treatment of statutory civil rights enforcement, including comparisons with constitutional enforcement.
- Focus on racial justice: Examines the role, and frequent absence, of racial justice in the development and application of civil rights laws.
- Carefully edited cases: Focused excerpts highlight essential issues without unnecessary length.
- Charts and illustrations: Visual explanations clarify complex legal doctrines.
- A distinct subject focus: Concentrates on the enforcement of rights rather than the substance of individual rights, distinguishing the book from traditional courses in Constitutional Law, Criminal Procedure, and Employment Discrimination.

Rental Terms
Return by May 25, 2027 for Spring 2027 rentals.
- Late Fees
- Books returned after the semester deadline accrue a weekly late fee of about 10% of the book's Brand New price, for each copy that is overdue. The rent you have already paid counts toward the book's replacement value (its Brand New price), so late fees stop once your rent plus late fees reach it. That replacement value is the most a rental can ever cost you. We email a reminder 48 hours before any charge, and any late fees are charged to the payment method you save at checkout.
- Damage Fees
- Books returned damaged beyond normal classroom wear may be assessed a damage fee, capped at the book's replacement value (its Brand New price). Any damage fees are charged to the payment method you save at checkout after we inspect the returned book.
- Return Shipping
- Returning your book is free with no deduction if it reaches us by your semester return date, or after it's already overdue. Print a prepaid label (USPS or UPS, whichever is cheaper for your package) from your account's My Rentals page. Returning it early and shipping it back within 30 days of your order date gets you a refund minus a 15% restocking fee and the label cost. After 30 days, an early return is free, with no refund.
- 30-Day Refund Window
- Changed your mind? Cancel before your book ships and it’s free: open the order under My Account → Orders and click Cancel next to the book. Once it has shipped, you can return a rental for a refund from My Account → My Rentals. To qualify, the book must be shipped back within 30 days of your order date. We refund the rental price minus a 15% restocking fee and the return label cost, released once we receive your book. Shipping is non-refundable. A rental shipped back after 30 days is a regular end-of-semester return, with no refund.
